How to Sublet Your Apartment Legally (Without Getting Burned)

    By x96i8October 26, 2026

Life has a way of rearranging itself before a lease ends. A job offer in another city, a family emergency, a semester abroad. Suddenly you are staring at months of rent for a place you will not be living in. Subletting looks like the obvious escape hatch, and it can be, but only if you do it properly. Do it carelessly and you could find yourself in breach of your lease, liable for someone else’s damage, or fighting over unpaid rent with a person you barely knew.

    What subletting actually is

When you sublet, you remain the tenant under your original lease, and you rent all or part of the apartment to a second person, the subtenant. You are still responsible to your landlord for the rent and the condition of the place. The subtenant answers to you, not to the landlord. That layered arrangement is why subletting carries more risk than people expect.

It is not the same as an assignment, where you hand over your entire lease to someone else and step out of the picture. Assignments are rarer, and landlords often treat them differently. Check which one your lease allows.

Read your lease before you post anything

Start with the lease, not the listing. Many leases say subletting is allowed only with written consent. Some ban it outright. Others allow it with conditions, such as a screening fee or a limit on how long a subtenant can stay. Subletting without permission when your lease requires it can be treated as a violation, and in the worst case it can lead to eviction proceedings.

Laws vary. In some places, tenants have a statutory right to request consent and landlords may not unreasonably refuse. In others, the lease terms decide. If you are unsure, a quick call to a local tenant rights group can save you real trouble.

Ask the landlord the right way

Put your request in writing. Explain why you need to sublet, how long, and who the proposed subtenant is, if you know. Offer to provide the subtenant’s application details. Landlords tend to say yes more readily when you make it easy: you are responsible, the rent will be paid on time, and the person is vetted. Keep a copy of the reply. A verbal okay is worth very little if a dispute arises later.

Screen the subtenant like a landlord would

This is the part people skip, and it is the part that protects you. Ask for an application, proof of income, references and a government ID. Consider a background and credit check, and be aware that screening rules exist in many places, including limits on what you can ask and how you can use the results. Meet the person, or at least hold a video call. Trust your instincts. If something feels off, keep looking.

Put it all in a sublease agreement

A good sublease is a short, clear document. It should name everyone, identify the property, state the start and end dates, set the rent and due date, and say who pays utilities. It should also cover the security deposit, house rules, guest and pet policies, and what happens if the subtenant leaves early. Spell out that the subtenant must follow the terms of the main lease. Attach a copy of the main lease if the landlord approves.

    Handle money carefully

Collect a security deposit from the subtenant, and keep it separate from your own funds. Check whether your state limits the amount or requires a particular way of holding it. Take the rent by a traceable method, such as a bank transfer, and give receipts. Since you are the one on the hook to the landlord, decide whether the subtenant pays you or the landlord directly, and write down how it works.

Document the condition of the apartment

Before the subtenant moves in, walk through together and photograph every room. Note scratches, stains and appliances that do not work. Have both of you sign a short condition report. When the sublease ends, you will have something concrete to compare, instead of an argument.

Know what you remain liable for

If the subtenant stops paying, you still owe the landlord. If they damage the unit, the landlord comes to you. This is the reason many people limit subleases to friends of friends or colleagues they can check on. Consider asking for the first month and a deposit upfront, and keep your renters insurance active. Also tell your insurer if someone else will be living in the unit, since some policies treat that differently.

Watch for scams and platform rules

Be wary of anyone who wants to pay by cheque for more than the amount and asks for the difference back, or who refuses to meet, or who pressures you to skip paperwork. Some cities regulate short-term sublets, and subletting on a nightly basis through vacation platforms is restricted or banned in many places and by many leases.

    A quick checklist

Get written landlord approval. Screen the subtenant. Sign a sublease. Collect a deposit. Document the condition. Keep the rent flowing to the landlord. Do these six things and a sublet can go smoothly for everyone.
